1. Acceptance of these Terms

These Terms of Service (the "Terms") govern your use of hunaipot.com (the "Site"), the Hunaipot application at app.hunaipot.com (the "Platform"), and every service we provide through them, including done-for-you persona builds and onboarding (together, the "Services"). Hunaipot ("Hunaipot", "we", "us", "our") provides the Services to you on these Terms.

By accessing the Site, creating an account, buying a plan, or booking a call with us, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Definitions

Account means the account you create on the Platform.
Persona means an AI creator character built on or supplied through the Platform, including its likeness, name, and associated settings.
Generated Content means any image, video, audio, caption, script, chat message, or other output produced using the Services, whether you generated it yourself or we generated it for you.
Your Content means anything you submit to the Services, including prompts, reference images, briefs, brand assets, reviews, testimonials, and messages you send us.
Third-Party Platform means any site or service where you publish or monetise Generated Content, including fan platforms, social networks, and payment providers.

3. Eligibility and accounts

You must be at least 18 years old, and old enough to view adult material where you live, to use the Services. By using the Services you confirm that you meet that requirement and that you have the legal capacity to enter into this agreement. If you use the Services on behalf of a company, you confirm you are authorised to bind it.

You are responsible for your Account credentials and for everything done through your Account. Tell us promptly at hello@hunaipot.com if you believe your Account has been compromised. We may suspend or close an Account that we reasonably believe is being used in breach of these Terms.

4. Plans, credits, and payment

Paid plans are billed in advance on the cycle shown at checkout and renew automatically until cancelled. Prices are shown on the Site and may change; a change takes effect at your next renewal, not mid-cycle. Payments are processed by our payment provider, and we do not store your full card details.

Some plans include generation credits. Credits are a licence to use capacity on the Platform, not money, and they have no cash value. Unless the plan says otherwise, credits do not transfer between accounts and are not refundable once spent.

You may cancel a subscription at any time from your Account. Cancelling stops future renewals and your plan runs to the end of the period you have already paid for. One-off purchases, including done-for-you persona builds, are non-refundable once work has started, because the work is bespoke to you. Nothing here removes any statutory cancellation or refund right you have as a consumer.

5. Licence to use the Services

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your own business purposes, subject to these Terms and to your plan. You may not resell, sublicense, or white-label access to the Platform itself without our written consent.

6. Ownership of Generated Content

As between you and Hunaipot, and provided your Account is in good standing, you own the Generated Content produced under your Account and may use, publish, and monetise it, including commercially. We do not claim ownership of it.

You should be aware that AI outputs may not be capable of copyright protection in every country, and that similar outputs may be produced for other customers. We do not warrant that any piece of Generated Content is unique.

7. Licence you grant to Hunaipot

You grant Hunaipot a worldwide, perpetual, irrevocable, royalty-free, fully paid, non-exclusive, transferable, and sublicensable licence to host, store, reproduce, adapt, modify, crop, re-format, translate, publish, publicly display, publicly perform, and distribute Generated Content and Your Content, in whole or in part, in any media now known or later developed, for the purposes of:

operating, providing, securing, and supporting the Services;
marketing, advertising, promotion, showcases, demonstrations, portfolios, case studies, social media, press, and partner or investor materials; and
any other purpose that furthers the Hunaipot business, including improving and developing our products and services.

This licence survives the closure of your Account and the termination of these Terms, so that material already published stays lawful. It does not transfer ownership to us, and it does not stop you using your own Generated Content in any way you like.

Where we use Generated Content under this licence, we are not obliged to credit you, and we will not identify you as the operator behind a Persona unless you ask us to in writing. If you would rather we did not use a particular item, write to hello@hunaipot.com and we will consider the request and stop future use where we reasonably can, although we may not be able to recall material already distributed.

You confirm that you have all rights needed to grant this licence, including in anything you upload, and that our use of it under this clause will not infringe anyone's rights.

8. Acceptable use

You must not use the Services to create, request, or publish:

any material that depicts, or appears to depict, a minor in a sexual or suggestive context. This is an absolute prohibition, it applies to fictional and AI-generated depictions, and we report suspected child sexual abuse material to the relevant authorities;
the likeness, face, voice, name, or identifying features of a real identifiable person without that person's documented, informed consent, including public figures;
sexual material depicting a real person without their consent, non-consensual intimate imagery, or content that sexualises non-consent, coercion, or trafficking;
content that is unlawful where it is created or published, that depicts extreme violence or bestiality, or that promotes terrorism, hate, or self-harm;
impersonation, fraud, catfishing for financial gain beyond the ordinary operation of a fan page, or any scheme that deceives people into payments they have not agreed to;
anything that breaks the rules of a Third-Party Platform you publish to, including rules about disclosing AI-generated content.

You also must not attempt to gain unauthorised access to the Services, interfere with their operation, scrape or bulk-extract from them, reverse engineer them, or use them to train a competing model.

We may review, refuse, remove, or restrict content and may suspend or terminate an Account for breach of this clause, without refund where the breach is serious.

9. AI-generated material and disclosure

Personas are synthetic. They are not real people, and any resemblance to a real person is unintended. Generated Content is produced by automated systems and can contain errors, artefacts, or unintended results.

You are responsible for labelling and disclosing AI-generated material where the law or a Third-Party Platform requires it, and for complying with any age-verification, record-keeping, tax, and advertising rules that apply to you in the places where you operate.

10. Third-Party Platforms

We do not control Third-Party Platforms. Your account, revenue, and standing on them are between you and them, and they can change their rules or remove your account at any time. We are not responsible for a Third-Party Platform's decisions, outages, payouts, or fees, and our Services are not a guarantee of acceptance on any of them.

11. No earnings guarantee

Any revenue figure shown on the Site, including calculators, examples, case studies, and testimonials, is illustrative and is not a projection of your results. Results depend on your niche, your promotion, the hours you put in, and factors outside anyone's control. We do not guarantee any level of income, and nothing in the Services is financial, legal, or tax advice.

12. Our intellectual property

The Site, the Platform, our software, models, prompts, templates, playbooks, branding, and copy are owned by Hunaipot or our licensors and are protected by copyright and trademark law. Except for the rights expressly granted in these Terms, you may not reproduce, distribute, modify, or create derivative works from them.

13. Suspension and termination

You may stop using the Services and close your Account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if continuing to provide the Services would expose us or others to real risk. On termination your right to use the Services ends, and clauses that by their nature should survive, including clause 7, will survive.

14. Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law we exclude all implied warranties, including fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or that any output will meet your requirements.

15. Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost revenue, lost data, or loss of a Third-Party Platform account. Our total liability arising out of or in connection with the Services is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred pounds sterling.

16. Indemnity

You agree to indemnify Hunaipot against claims, losses, and reasonable costs arising from your breach of these Terms, your use of Generated Content, or your activity on a Third-Party Platform.

17. Changes to these Terms

We may update these Terms. The date at the top of this page shows the current version. Where a change materially reduces your rights we will give reasonable notice by email or in the Platform before it takes effect. Continuing to use the Services after that point means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you keep the benefit of any mandatory protections of the country where you live.
